Before registering for or purchasing any services from us, it is critically important that you read and understand our Terms of Service (ToS).

Introduction
The following terms and conditions govern all services supplied by www.eservers.uk and its associated partners. Throughout this document, eServers.uk is a legally established entity referred to as the "Company." These rules apply to all users (heretofore known as "Subscribers" or "Clients"), whether you are utilizing free services or paying for subscriptions through eServers.uk. By accessing and using our platform, you provide your explicit consent to abide by the terms outlined below:

1. Client Age Requirements


1.1 Minimum Age: Any user creating an account or placing orders via the eServers.uk platform must be at least 18 years of age and hold the legal capacity to form a binding contract.

1.2 Underage Users: If a client is discovered to be under 18, they must immediately notify our team and cease using the services. Further use of the Company's infrastructure will be strictly prohibited.

1.3 Parental Consent: Individuals under 18 may only use our website and services with the direct, explicit permission of a parent or legal guardian. eServers.uk bears no responsibility or liability for any legal complications arising from a user misrepresenting their actual age.

2. Service Access and Usage Restrictions


2.1 Account Information & Verification: To access the eServers.uk control panel, users must provide accurate personal details, which are securely stored in our database. It is the client's responsibility to guarantee all submitted information is 100% factual and complete. Should we identify any manipulated, false, or omitted data, we reserve the right to deny service. Furthermore, suspected fraudulent behavior will result in immediate account suspension or termination without any possibility of a refund.

2.2 Licensing and Permitted Use: By agreeing to these Terms, you are granted a non-transferable, non-exclusive, and limited license to use our services. Our infrastructure is intended strictly for authorized commercial and private applications; any illegal activities are expressly forbidden. You must actively secure your services against unauthorized access. eServers.uk holds the right to implement network security protocols and enforce bandwidth limitations. Any violation of this license will result in instant termination and possible legal action under applicable laws.

3. Know Your Customer (KYC) Identity Verification


eServers.uk operates a strict KYC procedure to guarantee a secure and compliant network.

3.1 Mandatory Data Submission: Clients are required to supply authentic information, including their Full Name, current Address, Postal Code, Country, Phone Number, and Email Address.

3.2 Verification Rules: We gladly accept clients from all over the world; however, any orders processed through Tor networks, Proxies, or VPNs will be flagged and declined automatically. If we detect inaccurate or fabricated details, you will be granted a single chance to rectify your account by submitting a valid government ID along with biometric verification.

3.3 Refunds Regarding KYC Failures: In the event that a user fails the KYC verification process, refunds will ONLY be processed for transactions made via American Express (Amex), Mastercard, and Visa. Payments executed using Cryptocurrency or any other non-reversible gateways are completely non-refundable if KYC is failed. If a user purposely submits fake data or leaves KYC fields blank, the account will face a permanent ban, all associated funds will be frozen, and zero refunds will be provided.

4. Payments, Billing, Subscriptions, and Refunds


4.1 Invoicing & Deployment: Your selected services will only be provisioned after full payment is confirmed. Invoices are generated and sent 14 days prior to your billing due date. Clients must ensure payments are made on time.

4.2 Accepted Payment Methods & Overdue Balances: eServers.uk accepts Wire Transfers, Credit Cards, Cryptocurrency (USDT/Bitcoin), and other verified gateways. If an invoice remains unpaid for more than 24 hours past the due date, we hold the right to suspend or terminate the associated service until the balance is cleared.

4.3 Refund Limitations: eServers.uk operates on a NO REFUND policy. Exceptions are only made for verifiable billing errors or issues explicitly covered under our SLA (Section 11).

4.4 Automated Credit Card Billing: If you pay via Credit Card, you consent to automatic subscription renewals. The system will deduct funds automatically on each due date. We do not offer refunds for auto-renewed charges. To stop automatic billing, you must cancel the service via your client area or open a support ticket before the renewal date hits.

4.5 Setup Fees: Standard setup fees for renting dedicated servers are waived by default, unless your server requires specialized, custom third-party configurations.

5. Provided Services

6. Intellectual Property & Copyright


All content and materials provided on our website and network remain the exclusive property of eServers.uk. Copyright infringement is strictly forbidden. Users are not permitted to distribute, modify, copy, or transmit any of our proprietary content without formal written approval. Utilizing our services does not grant you any ownership over our intellectual property.

7. Acceptable Use Policy (AUP) & Prohibited Content


To preserve the performance and security of our infrastructure, eServers.uk strictly enforces this AUP. Using our network to promote, transmit, store, or host the following is completely banned:


1. Cybercrime & Network Abuse

  • Header Forgery & IP Spoofing: Altering email headers, network packets, or IPs to hide traffic origins.
  • DoS/DDoS Attacks: Facilitating or executing any form of Denial of Service network flooding.
  • C2 Servers & Malware: Distributing, hosting, or running ransomware, trojans, viruses, or Command & Control infrastructure.
  • Scanning & Probing: Unsanctioned vulnerability probing, port scanning, or brute-forcing against our network or external targets.
  • Credential Harvesting & Phishing: Hosting fake banking sites, deceptive login portals (like cPanel/webmail), or identity theft schemes.

2. Harmful & Illegal Material

  • CSAM (Child Sexual Abuse Material): Absolute zero-tolerance for promoting, hosting, or distributing child exploitation content. Such accounts face instant termination and immediate reporting to law enforcement.
  • Extremism & Terrorism: Material instructing on weapon creation or promoting violent/terrorist acts.
  • Human Trafficking: Content or services facilitating illegal prostitution or human trafficking.
  • Contraband & Illegal Substances: Promoting or selling unprescribed medications, illegal drugs, or related contraband.

3. Financial Crime & Fraud

  • Stolen Data & Carding: Storing or selling compromised identities, leaked databases, or stolen credit card details.
  • HYIPs & Ponzi Schemes: Hosting pyramid schemes, fraudulent crypto investments, or High-Yield Investment Programs.
  • Deceptive E-commerce: Running fake storefronts intended to scam buyers.

4. Spam & Email Abuse

  • Spam / UCE: Sending Unsolicited Commercial Email (bulk spam) or running mailing lists without explicit user opt-in.
  • SMS & Mail Bombers: Utilizing scripts to flood phones or inboxes with massive message quantities.
  • IP Blacklisting: Any behavior that causes our IP space to be flagged on databases like SORBS or Spamhaus.

5. Copyright & IP Violations

  • Pirated Software (Warez): Distributing unauthorized copyrighted media, cracks, keygens, or nulled software (e.g., nulled Windows/WHMCS/cPanel).

6. Resource Abuse & High-Risk Operations

  • Tor Exit Nodes: Running Tor exit relays due to the high volume of abuse complaints they generate.
  • Proxies & Open Resolvers: Operating publicly accessible Open Proxies or Open DNS resolvers that can be abused for amplification attacks.

Account Violation Consequences & Zero-Tolerance Protocol: If we discover unauthorized activities—such as hacker tools, pirated software, warez, or illegal MP3s—your account will be terminated instantly without warning. eServers.uk will also forward your details to the relevant authorities. We actively monitor traffic for network abuse. Violating this AUP grants us the absolute right to wipe, suspend, or permanently terminate your server without notice. No refunds will be given for services closed due to policy breaches.


STRICT COMPLIANCE & ZERO-TOLERANCE WARNING: Servers must never be utilized for malicious or illegal acts. Doing so results in immediate seizure without a refund. We have a Zero-Tolerance stance against Ransomware and Dark Web operations. If your server facilitates Ransomware, malicious Tor Exit Nodes, or Dark Web marketplaces, it will be confiscated instantly. Furthermore, your full KYC details, connection logs, and IP history will be unconditionally surrendered to local law enforcement and international cybercrime agencies for prosecution.

8. Service Suspension & Unpaid Invoices


8.1 Colocation Collateral: If a colocation account goes unpaid for over 30 days, eServers.uk legally reserves the right to take ownership of the colocated hardware.

8.2 Breach of Contract Terminations: Failing to pay invoices on time or violating these terms allows us to terminate or suspend your service immediately. Upon termination, we hold the right to securely erase all data on the server.

9. Setup Procedures & Service Upgrades


9.1 Upgrades: Any requested service upgrades will be applied at the beginning of your next billing cycle, unless you pay for the upgrade in full for immediate deployment.

9.2 Deployment Time: Standard service provisioning takes up to 24 hours. Bare metal dedicated server setups may take longer depending on hardware stock.

10. Cancellation Policy


To cancel a service, you must submit a verified ticket to our support team no later than 24 hours before your next invoice is due. Requesting a cancellation means you accept responsibility for all charges accrued up until the cancellation date. We do not provide pro-rated refunds for services canceled in the middle of a billing cycle.

11. Satisfaction Guarantee & Service Level Agreement (SLA)


eServers.uk provides a 99.99% network uptime guarantee. If internal network failures cause us to fall below this metric, clients may qualify for SLA service credits. Please note that setup fees are entirely non-refundable. Clients must open a ticket with our technical support team immediately to report issues and seek resolution.

12. Data Loss & Limitation of Liability


12.1 Client Backups: eServers.uk does not perform automatic data backups unless the client has specifically purchased a managed backup add-on. Subscribers hold sole responsibility for keeping remote, off-site backups of their critical server data.

12.2 Liability Restrictions: eServers.uk, alongside its employees and directors, shall not be held liable under any circumstances for indirect business losses, profit loss, security breaches, hardware degradation/failures, or data loss stemming from the use (or inability to use) our infrastructure.

13. Force Majeure


eServers.uk is not responsible for any delays, outages, or failures in fulfilling our ToS obligations if the cause is outside of our reasonable control. This includes, but is not limited to, power grid collapses, massive global internet disruptions, government restrictions, acts of terrorism, war, natural disasters, or acts of God.

14. Changes to the Terms of Service


eServers.uk retains the authority to modify, update, or amend these terms at any given time. Changes become effective the moment they are published on our official website. By continuing to use our services after an update, you explicitly agree to the new ToS. If you disagree with any amendments, you are required to stop using our services and submit a cancellation request immediately.

15. Jurisdiction and Governing Law


This Terms of Service agreement shall be interpreted and governed strictly under the laws of the United Kingdom. Any legal disputes or claims connected to these terms will fall under the exclusive jurisdiction of the United States court system.
